Thanks for using our services ("Fetch"). Fetch is provided by the Central Okanagan Division of Family Practice ("CODFP"). 

By using our Services, you are agreeing to these terms. Please read them carefully. 

Although the information provided on these Web sites is obtained or compiled from sources we believe to be reliable, CODFP makes no warranty as to the accuracy, validity, timeliness or completeness of any such information or data. CODFP has used reasonable care and skill in compiling the content of the Web sites, however the Web sites may contain typographical errors or technical inaccuracies. Information may be changed or updated without notice. CODFP may also make improvements and/or changes in the content of the Web sites at any time without notice. 

Any third party Web sites that may be accessed through the Services are the sole responsibility of the third party who is posting the Web site. CODFP makes no warranty as to the accuracy, validity, timeliness or completeness of any such information or data on such third party Web sites. Fetch Terms of Use for Providers 

Welcome to FETCH! 

Thank you for using our services ("Services" or “FETCH”)). The Services are provided by the Central Okanagan Division of Family Practice ("CODFP"). 

1. Using our Services 

You must follow any policies made available to you within the Services. 

Do not misuse the Services. For example, do not interfere with the Services or try to access them using a method other than the interface and the instructions that we provide. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. 

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications. 

2. Your FETCH Account 

You may need a FETCH Account in order to use some of our Services. You may create your own FETCH Account, or your FETCH Account may be assigned to you by a FETCH administrator. 

To protect your FETCH Account, keep your password confidential. You are responsible for the activity that happens on or through your FETCH Account. Try not to reuse your FETCH Account password on third-party applications. If you learn of any unauthorized use of your password or FETCH Account, please contact us immediately. 

3. Privacy and Copyright Protection 

CODFP’s privacy policies explain how we treat your data and protect your privacy when you use FETCH. By using FETCH, you agree that CODFP can use such data in accordance with our privacy policies. 

4. Your Content in Our Services 

Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours. CODFP may ask you to modify the content that you have uploaded to FETCH. 

CODFP may at any time choose to, but is not required to, remove your content from FETCH should it be found to be misleading, inappropriate or unlawful. 

You can find more information about how FETCH uses and stores content in the privacy policy. If you submit feedback or suggestions about our Services, we may use your feedback or suggestions without obligation to you. 

5. Modifying and Terminating our Services 

We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether. 

You can stop using our Services at any time. CODFP may also stop providing Services to you, or add or create new limits to our Services at any time. 

6. Our Warranties and Disclaimers 

We provide FETCH using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don't promise about our Services. 

CODFP ASSUMES NO LIABILITY FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR INCIDENTAL DAMAGES OF ANY KIND, LOST PROFITS, REVENUE, USE, BUSINESS INTERRUPTIONS, LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR OTHERWISE, WHETHER BROUGHT IN CONTRACT OR TORT, ARISING OUT OF OR CONNECTED WITH THE SERVICES, THE INABILITY TO USE THE SERVICES OR THE USE, RELIANCE UPON OR PERFORMANCE OF ANY MATERIAL CONTAINED IN OR ACCESSED FROM THE SERVICES OR ANY LINKED WEB SITE, EVEN IF CODFP IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT 

IN ALL CASES, CODFP WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE. 

7. Business uses of our Services 

If you are using our Services on behalf of a business or other organization, that body accepts these terms. It will hold harmless and indemnify CODFP and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees 

8. About these Terms 

We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We'll post notice of modifications to these terms on this page. We'll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service. 

These terms control the relationship between CODFP and you. They do not create any third party beneficiary rights. 

If you do not comply with these terms, and we don't take action right away, this doesn't mean that we are giving up any rights that we may have (such as taking action in the future). 

If it turns out that a particular term is not enforceable, this will not affect any other terms.
